Terms and Conditions (GTC) – EDELWILD Almchalet
§ 1 Scope of Application: These Terms and Conditions apply to the accommodation at EDELWILD Almchalet between the landlord (operator) and the guest (booker). Subletting or re-letting requires prior written consent.
§ 2 Booking & Payment: The contract is concluded upon booking confirmation. The total booking price (100%) is due immediately and must be paid within 2 working days. In the event of default, the claim to the chalet is forfeited; the payment obligation remains unaffected.
§ 3 Prices & Security Deposit: Prices include VAT, excluding local tourism tax. A security deposit of EUR 300.00 is due before the keys are handed over. The refund will be processed within 2 days after the chalet is returned without any damage.
§ 4 Cancellation (100% Fee): There is no statutory right of withdrawal for distance contracts (§ 18 Abs. 1 Z 10 FAGG). A contractual cancellation ban applies (non-refundable rate). In the event of cancellation, premature departure, or non-arrival (no-show), 100% of the price is charged. Saved expenses (e.g., cleaning) or proceeds from re-letting will be credited. Travel insurance is highly recommended.
§ 5 Cancellation by the Landlord: The landlord may withdraw from the contract in the event of force majeure, payment default, or false statements, and may terminate the contract without notice in case of persistent disturbance (e.g., property damage).
§ 6 Arrival/Departure: Check-in from 15:00 (3 PM), check-out by 10:00 (10 AM) swept clean. In the event of verschuldetem key loss, the guest is liable for the costs of replacing the locking system.
§ 7 Use & House Rules: Maximum occupancy according to the booking. A strict smoking ban applies indoors (violation: cleaning costs from EUR 250.00). Pets are only allowed by prior arrangement/surcharge. House rules must be observed.
§ 8 Liability: The guest is liable for all culpable damage caused by themselves, their fellow travelers, or their pets. Damage must be reported immediately. The landlord's liability for slight negligence (except for personal injury) is excluded.
§ 9 Final Provisions: Data will only be processed in accordance with the contract. Amendments must be made in writing. Austrian law applies. The place of jurisdiction is the location of the chalet.
Privacy Information on Video Surveillance (Art. 13 GDPR)
1. Data Controller: Manuela Wolf, Wörthersee Süduferstraße 229, 9082 Maria Wörth.
2. Purpose & Legal Basis: Protection of property, buildings, and guest vehicles based on legitimate interests (Art. 6 Abs. 1 lit. f GDPR in conjunction with § 12 DSG Austria).
3. Monitored Area & Recording: The camera only captures the parking lot, driveway, and entrance area. Absolutely no indoor, terrace, or audio recording.
4. Retention Period: Deletion/overwriting after 48 hours, unless required to preserve evidence for official legal proceedings.
5. Recipients: Data remains locally secured. Forwarding only in case of damage or criminal incidents to the police, courts, lawyers, or insurance companies.
6. Your Rights: Rights to access (Art. 15), erasure (Art. 17), restriction of processing (Art. 18), and objection (Art. 21) with the data controller. Right to lodge a complaint with the Austrian Data Protection Authority (Österreichische Datenschutzbehörde, Barichgasse 40–42, 1030 Wien, dsb@dsb.gv.at).
